The best operational and organizational structure will not help to succeed without supervising compliance with policies and procedures enacted and with the law. The supervision legally acceptable will take place in two phases: in the first phase there will be direct controls by line managers during »production« before the company delivers its services or products to the client. The second phase is executed at a later stage: from article 91 paragraph 2 AktG an obligation to provide for an adequate risk management and a congruent internal auditing is inferred – directly for joint stock companies and for other companies of certain volumes (midsize companies) by analogy... – topics:
